Since he mentions Emma plays fair so he doesn't immediately give up, i'm guessing that means there have been times where Tom grew tired of this game and given up?

With people other than Emma, he's basically learned sometimes it's not worth the energy to fight back. Sometimes it's easier to just ride it out.
